Valley City Man Sentenced to Prison for Escape

Jeffrey E. Withrow, 44, of Columbia Road in Valley City, entered a plea of guilty to one count of Escape, a second degree felony on Monday, December 13, 2010 in Judge Kimbler's courtroom. Judge Kimbler accepted the plea. Both the State and Mr. Withrow waived a presentence investigation. Following the waiver, Judge Kimbler imposed a two year prison sentence with credit for 118 days served in the Medina County Jail prior to sentencing. Following his release from prison, Mr. Withrow will be on post-release control to the Adult Parole Authority for two years.

Judge Kimbler's Criminal Docket for November 29, 2010

Six defendants appeared in Judge Kimbler's courtroom on Monday, November 29, 2010, and entered changes of plea to their charges. The defendants who changed plea were:

Michael A. Reddish of Imagine Lane in Medina, Ohio, entered pleas of no contest to twelve felony charges involving images of nude children. One of the counts was a fifth degree felony and the other 11 counts were second degree felonies. The fifth degree felony was a charge of Illegal Use of a Minor in a Nudity Oriented Performance. The 11 second degree felonies were all charges of Pandering Sexually Oriented Material Involving a Minor.

Judge Kimbler took Mr. Reddish's no contest plea to all 12 counts and found him guilty of all twelve counts. Judge Kimbler ordered a pre-sentence investigation and will impose sentence on January 6, 2010 at 8:30 am.

George L. Quinones of Miner Drive in Medina, Ohio entered two pleas of no contest to two charges of Trafficking in Drugs, Cocaine, both felonies of the fifth degree. Judge Kimbler found Mr. Quinones guilty of both counts and ordered a pre-sentence investigation. Judge Kimbler will impose sentence on January 6, 2010 at 8:30 am.

David P. Daigle of Durling Drive in Wadsworth, Ohio, entered two guilty pleas to two charges of Trafficking in Drugs. One charge was a felony of the third degree and the other was a felony of the fourth degree. The third degree felony involved the drug Oxycodone and the other charge involved the drug Methadone. Judge Kimbler ordered a pre-sentence investigation and will impose sentence on January 14, 2010 at 8:30 am.

Isaiah S. Casto of North State Road in Medina, Ohio, entered a no contest plea to one count of Trafficking in Drugs, a fifth degree felony. Judge Kimbler found him guilty of that charge, ordered a pre-sentence investigation and will impose sentence on January 6, 2011 at 8:30 am.

Christopher P. Flaesgarten of Coon Club Road in Medina, Ohio, entered a no contest plea to one count of Theft, a fourth degree felony. The indictment alleged that Mr. Flaesgarten stole jewelry valued at between $5,000 and $100,000. Judge Kimbler found him guilty and ordered a pre-sentence investigation. Judge Kimbler will impose sentence on January 6, 2011 at 8:30 am.

Marvin K. Waddle, II, of Bank Street in Lodi, Ohio, entered a guilty plea to one count of Felonious Assault, a second degree felony. Mr. Waddle also admitted to violating his probation in an earlier criminal case. Originally Mr. Waddle was charged with two counts of felonious assault, but the State agreed to dismiss one count if he entered a guilty plea to the remaining count. Judge Kimbler revoked his bond and ordered a pre-sentence investigation. Judge Kimbler will impose sentence on January 6, 2011 at 8:30 am.

Judge Kimbler Changes of Plea for Monday, October 18, 2010

Judge James Kimbler took three changes of plea on Monday, October 18, 2010. He took the changes of plea before starting a criminal jury trial. In all three cases Judge Kimbler ordered a presentence investigation and continued the defendant's bond. Judge Kimbler will sentence all three defendants on December 3, 2010 starting at 8:30 am. The defendants who entered the changes of plea are as follows:

Andrea Anderson, 32, of Lancelot Street in Streetsboro entered a plea to a charge of Permitting Drug Abuse, a fifth degree felony. Originally Ms. Anderson had been charged with another fifth degree felony. The State amended the charge and Ms. Anderson entered a guilty plea.

Thomas F. Higgins, III, 26, of Winterberry Lane in Medina, entered a plea of no contest to three counts of Illegal Processing of Drug Documents, and was found guilty of all three charges. All three charges are felonies of the fifth degree.

Lynn M. Grace-Anspach, 24, of North State Street in Medina, Ohio, entered a plea of guilty to an amended charge of Theft, a first degree misdemeanor.

Four Defendants Change Plea in Judge Kimbler’s Courtroom on Tuesday, October 12, 2010

Leann N. Gibson, 29, of Cross Creek Boulevard in Brunswick, Ohio entered a change of plea on Tuesday, October 12, 2010 to two criminal charges. She had been indicted for one count of Theft and one count of Forgery, both fifth degree felonies. She entered a no contest plea to both charges and was found guilty. Judge Kimbler ordered a presentence investigation. Sentence will be imposed on November 18, 2010

Delmar R. Bates, 62, of Grafton Road in Brunswick, Ohio entered a change of plea to one count of Theft, a misdemeanor of the first degree on Tuesday, October 12, 2010. Originally Mr. Bates had been indicted for one misdemeanor count and one felony count. The State agreed to drop the felony charge if he entered a guilty plea to the misdemeanor charge. Judge Kimbler ordered a presentence investigation and will impose sentence on November 18, 2010.

Kimberly L. Mance, 40, of Muirland Drive, Broadview Heights, Ohio entered a change of plea to the charge of Drug Trafficking, a fifth degree felony on Tuesday, October 12, 2010. Ms. Mance entered a no contest plea and was found guilty. Judge Kimbler then ordered a presentence investigation and will impose sentence on November 18, 2010.

Gilbert N. Yezbak, Jr., 45, of Norwood Drive in Brookpark, Ohio entered a change of plea to one count of Possession of Drugs, a fifth degree felony. Mr. Yezbak entered a plea of no contest. After finding him guilty, Judge Kimbler ordered a presentence investigation and will impose sentence on November 18, 2010.

Judge Kimbler Sentences Two Defendants Who Assaulted County Inmate to Prison

Judge Kimbler has sentenced James E. Polanski, 27, and Logan P. Clark, 22, both of whom are inmates in the Lorain Correctional Institution to one year in prison for Attempted Aggravated Assault, a fifth degree felony. The victim in the assault was an inmate of the Medina County Jail who was in jail due to being charged with a sex offense. The State of Ohio alleged that both Polanski and Clark were aided in the attempted assault by a Medina County Corrections Officer. The Corrections Officer was also indicted for this offense, and his case is still pending.

Both Polanski and Clark entered guilty pleas to the assault charge. Although both were charged with more serious offenses, the State agreed to amend the charges in exchange for the men telling the County Prosecutor’s Office what they knew about the case. Both men also agreed to testify if the charge against the Corrections Officer goes to trial.

Polanski entered his change of plea on August 16, 2010 and Clark entered his change of plea on October 12, 2010. Judge Kimbler sentenced Polanski on October 7, 2010 and sentenced Clark on October 12, 2010.

Two Defendants Change Pleas in Judge Kimbler's Court

Medina County Prosecutor Dean Holman reports that the following defendants appeared in Judge Kimbler's courtroom on Thursday, October 7, 2010 and entered a change of plea:

Michael Barber, 30, of Biggs Road in Grafton, pleaded guilty to two counts of Burglary, both of which are second-degree felonies and one count of Possession of Criminal Tools, a fifth-degree felony. Sentencing is scheduled for November 18.

Nathan Haynes, 36, of Wakefield Drive in Akron, pleaded no contest to one count of Possession of Cocaine, a fifth-degree felony. Sentencing is scheduled for November 18.

Four Defendants Change Pleas in Judge Kimbler's Court

On Monday, October 4 through Wednesday, October 6, 2010, four defendants entered changes of plea in Judge Kimbler's courtroom. They are as follows:

Scott A. Shamp, 44, of Township Road 466 in Lakeville, Ohio, entered a plea of guilty to one count of Non-Support of Dependents, a fifth degree felony. Judge Kimbler took the change of plea and ordered a pre-sentence investigation. Judge Kimbler will impose sentence on November 12, 2010 at 8:30 am. Judge Kimbler continued Mr. Shamp's bond.

Jaclyn K. Gibbons, 20, of State Road in Parma, entered a plea of no contest to two counts of Drug Trafficking, both fifth degree felonies. Judge Kimbler ordered a pre-sentence investigation. Sentence will be imposed on November 18, 2010 at 8:30 am. Bond was continued.

Lukas D. Caraballo, 24, of Center Road in Brunswick, Ohio, entered a plea of no contest to one count of Trafficking in Drugs, a fourth degree felony. Judge Kimbler ordered a pre-sentence investigation and will impose sentence on November 12, 2010 at 8:30 am. Bond was continued.

Gary J. Spry, 20, of Fifth Street in Akron, Ohio, entered a plea of no contest to one count of Drug Trafficking, a fourth degree felony. Judge Kimbler ordered a pre-sentence investigation and continued his bond. Sentence will be imposed on November 12, 2010 at 8:30 am.

Two Women Change Plea in Drug Trafficking Cases

Two women who were each charged with trafficking in drugs appeared in Judge Kimbler's courtroom on Tuesday, September 14, and changed their pleas. They were Elizabeth K. O'Connor and Desiree M. O'Neill.

Ms. O'Connor was charged with two counts of Trafficking in Drugs, Oxycodone, a Schedule II drug, with each count being a fourth degree felony. Ms. O'Connor, 48, who lives on West Washington Street in Medina, Ohio will be sentenced on October 21, 2010, following a pre-sentence investigation. Judge Kimbler continued her bond while her case is pending for sentence.

Ms. O'Neill was charged with two counts of Trafficking in Drugs, Cocaine, a Schedule II drug, with each count being a fifth degree felony. Ms. O'Neill, 25, who lives on Beverly Hills Drive in Brunswick, Ohio will also be sentenced on October 21, 2010, following a pre-sentence investigation. At the request of her defense attorney, Ms. O'Neill will be evaluated for placement in a community based correctional facility in either Summit or Lorain county. Judge Kimbler also continued Ms. O'Neill's bond while her case is pending for sentence.

Two Defendants Change Plea in Judge Kimbler's Courtroom on Monday, September 13

Two defendants appeared in Judge Kimbler's courtroom on Monday morning and entered changes of plea to amended charges. The two defendants were Robert E. Dunn, 46, of West 73rd Street, Cleveland, Ohio and Randall Finkell, 25, of State Route 58 in Wellington, Ohio.

Mr. Dunn entered a guilty plea to one count of Failure to Give Notice of a Change of Address, a third degree felony and Mr. Finkel entered a guilty plea to one count of Theft from the Elderly, a fifth degree felony.

In both cases Judge Kimbler continued the bond and ordered a pre-sentence investigation. Both defendants will be sentenced on October 28, 2010 at 8:30 am.

Akron Woman Pleads to Receiving Stolen Property from Lodi Outlets Mall

Makeda D. Carey of Danmead Avenue in Akron, Ohio, appeared in Judge Kimbler's courtroom on Wednesday, August 18, and entered a plea of no contest to a charge of Receiving Stolen Property, a fifth degree felony, and Possessing Criminal Tools, a fifth degree felony. Judge Kimbler accepted the no contest pleas and found her guilty. Judge Kimbler then continued her bond and ordered a pre-sentence investigation. The indictment alleges that the victims were the Children's Place, Eddie Bauer, and Ralph Lauren stores in the Lodi Outlet Mall in southern Medina County. Judge Kimbler will impose sentence on September 30, 2010.

Changes of Plea in Judge Kimbler's Courtroom for August 13, 2010

Medina County Prosecutor Dean Holman reports that the following defendants appeared in Judge Kimbler’s courtroom on August 13, 2010, and entered the following changes of plea in their criminal cases:

Donald Nichols, of Parsons Road in LaGrange, Ohio, entered a plea of guilty to a misdemeanor charge of Criminal Trespass on Railroad Property, a first degree misdemeanor. Sentencing is scheduled for September 23, 2010.

Thomas Traut, 33, of Gaylann Drive in Brunswick, pleaded guilty to two counts of Trafficking in Marijuana, both of which are fifth-degree felonies. Sentencing is scheduled for September 30.

Kimberly Waters, 39, of Lovers Lane in Akron, pleaded no contest to one count of Receiving Stolen Property and one count of Possession of Criminal Tools, both of which are fifth-degree felonies. Sentencing is scheduled for September 23.

Two Defendants Change Plea in Drug Trafficking Cases

Two defendants who were scheduled for trial in Judge Kimbler's court entered changes of plea on Tuesday, August 10, 2010.

Christi L. Leprevost of Strongsville, Ohio, entered a plea of "no contest" to one count of Trafficking in Drugs within the Vicinity of a Juvenile, a fourth degree felony. Judge Kimbler ordered a pre-sentence investigation and set sentencing for September 23, 2010 at 8:30 am. Judge Kimbler continued Ms. Leprevost's bond pending sentencing.

Deaire D. Ricks of Akron, Ohio entered a plea of "no contest" to one count of Trafficking in Drugs, a fifth degree felony. Mr. Ricks also agreed to forfeit to the State the sum of $95.76, which the State claimed were proceeds from drug trafficking. Judge Kimbler accepted the no contest plea and ordered a pre-sentence investigation. Judge Kimbler will sentence Mr. Ricks on September 30, 2010. Mr. Ricks remains out on bond pending sentencing.

Arraignments and Changes of Plea in Judge Kimbler's Courtroom on July 29, 2010

Medina County Prosecutor Dean Holman reports that the following defendants appeared in Judge Kimbler’s courtroom for arraignments or for a change of plea hearing on July 29, 2010:

Daniel Akers, 41, of Kimmich Drive in Brunswick, pleaded not guilty to one count of Domestic Violence, a fourth-degree felony. A jury trial is scheduled for September 29.

Richard Boreman, 47, of Bank Street in Lodi, pleaded not guilty to one count of Trafficking in Drugs, a fourth-degree felony. A jury trial is scheduled for September 14.

Lisa Elfers, 23, of Brendan Lane in North Olmsted, pleaded not guilty to one count of Theft and one count of Passing Bad Checks, both of which are fifth-degree felonies. A jury trial is scheduled for September 28.

Michelle Foglesong, 30, of West 81st Street in Cleveland, pleaded not guilty to one count of Possession of Heroin, a fifth-degree felony. A jury trial is scheduled for September 27.

Russell R. James, 26, of Boston Road in Strongsville, pleaded not guilty to one count of Possession of Drugs, a fifth-degree felony. A jury trial is scheduled for September 27.

Robert Krumwiede, 21, of Crestwood Avenue in Lakewood, pleaded guilty to one count of Receiving Stolen Property and one count of Possession of Cocaine, both of which are fifth-degree felonies. He was sentenced to three years of community control sanctions, with a period of time in a Community Based Correction Facility.

Darnell Milton, 40, of East 110th Street in Cleveland, pleaded no contest to one count of Theft of a Motor Vehicle, a fourth-degree felony. Sentencing is scheduled for September 16.

Marvin Neal, 23, of Bursley Road in Spencer, pleaded no contest to two counts of Felonious Assault, both of which are second-degree felonies. One of the counts carries the specification that the victim was pregnant at the time of the assault. Sentencing is scheduled for September 16.

Michael Reddish, 36, of Imagine Lane in Medina, pleaded not guilty to one count of Illegal Use of a Minor in Nudity-Oriented Material or Performance, a fifth-degree felony. A jury trial is scheduled for September 20.

Michael Scott, 28, of Hadcock Road in Brunswick, pleaded not guilty to two counts of Trafficking in Cocaine, both of which are fifth-degree felonies. A jury trial is scheduled for September 28.

Kevin Taylor, 21, of South Medina Line Road in Wadsworth, pleaded no contest to one count of Failure to Comply with a Police Officer, a third-degree felony. Sentencing is scheduled for September 16.

Brunswick Man Changes Plea in Judge Kimbler's Court

On Monday, June 7, 2010, Mr. Raymond V. Gunderman of 270 Manitoulin Pike in Brunswick, Ohio appeared in Judge Kimbler’s courtroom with his attorney Mr. L. Ray Jones. Originally Mr. Gunderman had been charged with two counts.

The first count of his indictment alleged that he committed the crime of Unlawful Possession of a Dangerous Ordinance, a second degree felony. The second count alleged that he committed the crime of the Illegal Manufacture of Drugs or the Illegal Cultivation of Marijuana, a fourth degree felony.

The State of Ohio dismissed the first count and filed a bill of information charging Mr. Gunderman with the Illegal Manufacture of Fireworks, a third degree felony. Following the filing of the bill of information, Mr. Gunderman waived his right to have the new charge presented to a grand jury and entered guilty pleas to the new charge and the original second count charging him with drug possession.

Judge Kimbler then ordered a presentence investigation and continued his bond. Judge Kimbler will sentence Mr. Gunderman on July 15, 2010.

Husband and Wife Change Pleas in Judge Kimbler's Courtroom

On Monday, May 24, 2010, Mr. Allen J. Pawl and Ms. Kimberly A. Henry of Springbrook Street in Medina, who are married, entered pleas of "no contest" to charges for drug trafficking and drug possession. Both were charged with one count of Trafficking in Drugs in the Vicinity of a Juvenile, and with Possession of Drugs. Both charges are fourth degree felonies. Judge Kimbler referred each of them to the Medina County Adult Probation Department. Judge Kimbler will impose sentence on July 9, 2010.

Judge Kimbler also took a change of plea today from Ms. Jamie Maynard of Abbeyville Road in Medina, who was charged with one count of Possession of Drugs, a fifth degree felony. Ms. Maynard entered a plea of "no contest" and was found guilty. Judge Kimbler ordered a pre-sentence investigation and will impose sentence on July 9, 2010.

In all three cases, Judge Kimbler continued the bond. Ms. Maynard is being evaluated for placement in a community based correctional facility in Lorain County.

Three Defendants Change Plea in Judge Kimbler's Court on Monday, April 5

Three defendants appeared in Judge Kimbler’s courtroom on Monday, April 5, 2010, to enter a change of plea in their cases. They were:

Shannon A. West of 12252 Smith Road, Wellington, Ohio, who entered a plea of “no contest” to one count of Theft in excess of $5000.00 from the Elderly, a third degree felony. Judge Kimbler ordered a pre-sentence investigation and will impose sentence on May 20 2010. Her bond was continued pending sentencing.

Caleb M. Klinksiek of 3492 Sturbridge Lane, Brunswick, Ohio, who entered a plea of “no contest” to one count of Robbery, a second degree felony. Judge Kimbler ordered a pre-sentence investigation and will impose sentence on May 20, 2010. Mr. Klinksiek remains incarcerated in the Medina County Jail pending sentencing.

Amanda C. Justice of North Pardee Street and NorthPark Drive, Wadsworth, Ohio, who entered pleas of “no contest” to 14 charges. The charges included one count of Receiving Stolen Property, six counts of Breaking and Entering, six counts of Vandalism, and one count of Complicity to Commit Breaking and Entering. All of the charges are fifth degree felonies. Judge Kimbler ordered a pre-sentence investigation and Ms. Justice remains incarcerated in the Medina County Jail pending sentencing.

Two Women Scheduled for Trial Change Pleas

On Monday, March 22, 2010, two defendants who were scheduled for trial in Judge Kimbler's court changed their pleas.

Jessica J. Daversa of Chatham Road in Spencer, Ohio, entered a plea of no contest to two charges involving morphine. The first charge, Trafficking in Drugs in the Vicinity of a Juvenile, is a fourth degree felony. The second charge, Possession of Drugs, is a fifth degree felony. After accepting the change of plea, Judge Kimbler ordered a pre-sentence investigation and continued her bond.

Michelle A. Just of Heather Lane in Medina, Ohio, entered a plea of no contest to four changes involving oxycodone. All were felonies of the third degree. Two of the charges were Trafficking in Drugs in the Vicinity of a Juvenile and two were Possession of Drugs. After accepting the change of plea, Judge Kimbler ordered a pre-sentence investigation and continued her bond.

The sentencing date for both women will be April 29, 2010.

Strongsville Man Pleads Guilty to Theft Charge

Michael T. Peck of Lanier Lane in Strongsville entered a plea of guilty to a misdemeanor theft charge in Judge Kimbler’s court on Wednesday, March 10, 2010. Mr. Peck was originally indicted for a felony theft offense.

The State alleged in the indictment that Mr. Peck had stolen a firearm, which is a felony offense. The alleged victim was his uncle. At the change of plea hearing the State told Judge Kimbler that Mr. Peck’s uncle was now claiming that there had been a “misunderstanding” involving the taking of the uncle’s firearm. Based on the uncle’s statements regarding the taking of the firearm, the State decided to reduce the charge to a misdemeanor.

Judge Kimbler took the change of plea and ordered a pre-sentence investigation. Sentencing will take place on April 29, 2010. Judge Kimbler continued Mr. Peck’s bond.
