Barberton Man Found Guilty in One Day Trial

Michael A. Maile, formerly of Liberty Avenue in Barberton, Ohio, was found guilty by a jury in Judge Kimbler's court on Tuesday, May 10, 2011. The entire trial took place in one day, starting with jury selection at 10 am and concluding with Judge Kimbler imposing a 10 month prison sentence at 4:15 pm. The State called three witnesses and Mr. Maile exercised his constitutional right not to testify or present evidence.

Mr. Maile was charged with one count of Drug Possession, a fifth degree felony. The drug involved was oxycodone. The charge grew out of a arrest that took place on February 15, 2010 when Wadsworth Police Department officers executed an arrest warrant for Mr. Maile that had been issued by the Summit County Common Pleas Court. During the arrest, the Wadsworth officers discovered marijuana and pills.

The pills turned out to contain oxycodone. Mr. Maile admitted that the pills were his and that he had been crushing them and then inhaling them. The officer also found scales of the type commonly used for weighing drugs and rolled up dollar bills with a white residue on them.

Following the verdict, Mr. Maile and the State waived a pre-sentence investigation report and Judge Kimbler imposed sentence. Judge Kimbler imposed a 10 month prison sentence but gave him jail time credit of 158 days. The prison sentence was consecutive to the six year prison sentence that Mr. Maile is presently serving out of Summit County.

Jury Finds Wadsworth Woman Guilty of Drug Possession

A jury returned a guilty verdict late Wednesday afternoon in Judge Kimbler's courtroom in a drug possession case. The defendant, Toni Amodio, 29, of Main Street in Wadsworth, Ohio, will be sentenced on March 17, 2011 following a pre-sentence investigation. Ms. Amodio will remain out of bond pending her sentencing. Besides ordering a pre-sentence investigation, Judge Kimbler added the condition that she provide weekly drug screens starting the week of January 31, 2011.

The jury trial started on Tuesday, January 25, 2011. The State called four witnesses and Ms. Amodio called one witness. She also testified in her own defense. The drug possession case arose out of the execution of a search warrant on July 22, 2010 by agents of the Med-Way Drug Task Force. This is Ms. Amodio's second conviction for a drug offense. She was earlier found guilty of Trafficking in Heroin in the Summit County Common Pleas Court.

Lodi Man Sentenced to Prison Following Change of Plea

Judge James Kimbler sentenced a Lodi man, David J. Scherman, 25, of River Street, to six months in prison on Wednesday, January 19, 2011, following a change of plea. Mr. Scherman was charged with one count of Possession of Drugs, (Heroin), and one count of Vandalism. The vandalism charge was based on his attempts to damage a Lodi police cruiser following his arrest on the drug possession charge.

Judge Kimbler gave Mr. Scherman credit for the 75 days he served in the Medina County Jail prior to his change of plea. Judge Kimbler also waived all court costs.

Wadsworth Woman Changes Plea in Drug Case

Susan E. Farr, 55, of Raven Place in Wadworth, Ohio, entered a change of plea in Judge Kimbler's courtroom on Monday, December 13, 2010, to one count of Drug Possession, a fifth degree felony. Ms. Farr entered a plea of no contest to the charge. Judge Kimbler accepted the plea, found her guilty, and ordered a presentence investigation. Sentence will be imposed on January 21, 2010. Judge Kimbler continued Ms. Farr's bond pending sentencing.

Strongsville Man Receives Seven Month Prison Sentence

Judge James L. Kimbler sentenced Eric J. Bruner of Winchester Court in Strongsville to seven months in prison for Possessing Drugs, Heroin, a fifth degree felony. Judge Kimbler ordered that the prison sentence be served concurrently with a sentence imposed by the Cuyahoga County Court of Common Pleas. Judge Kimbler imposed the sentence immediately after taking a change of plea from Mr. Bruner.

Brunswick Man Changes Plea in Judge Kimbler's Court

On Monday, June 7, 2010, Mr. Raymond V. Gunderman of 270 Manitoulin Pike in Brunswick, Ohio appeared in Judge Kimbler’s courtroom with his attorney Mr. L. Ray Jones. Originally Mr. Gunderman had been charged with two counts.

The first count of his indictment alleged that he committed the crime of Unlawful Possession of a Dangerous Ordinance, a second degree felony. The second count alleged that he committed the crime of the Illegal Manufacture of Drugs or the Illegal Cultivation of Marijuana, a fourth degree felony.

The State of Ohio dismissed the first count and filed a bill of information charging Mr. Gunderman with the Illegal Manufacture of Fireworks, a third degree felony. Following the filing of the bill of information, Mr. Gunderman waived his right to have the new charge presented to a grand jury and entered guilty pleas to the new charge and the original second count charging him with drug possession.

Judge Kimbler then ordered a presentence investigation and continued his bond. Judge Kimbler will sentence Mr. Gunderman on July 15, 2010.

Cleveland Man Sentenced to Prison After Change of Plea

Keanon O. Jackson of West 31st Street in Cleveland, Ohio, appeared in Judge Kimbler's court for the continuation of a hearing on his motion to suppress evidence. Prior to the commencement of the hearing, however, the State and Mr. Jackson reached an agreement. Under the terms of the agreement Mr. Jackson would enter a plea of "no contest" to two counts of drug possession. The first count was for Drug Possession, (Marijuana), a felony of the fifth degree and the second count was for Drug Possession, (Cocaine), a felony of the second degree. The State and Mr. Jackson also agreed to recommend a prison sentence of six months on the first count and a prison sentence of two years on the second count.

Mr. Jackson then changed his plea on both counts. Judge Kimbler found him guilty of both counts and sentenced him to prison. The prison sentence on the first count was for six months and the prison sentence on the second count was for two years. The two prison sentences run concurrently. Judge Kimbler also suspended his license for six months and imposed a mandatory fine of $7500.00, but suspended the fine and waived all court costs. Judge Kimbler also imposed a mandatory three year period of post-release control when Mr. Jackson is released from prison.
