Judge Kimbler's Criminal Docket for December 31, 2009

Medina County Prosecutor Dean Holman reports that the following people appeared in Judge Kimbler's court for criminal cases on December 31, 2009:

Judge Kimbler sentenced Laura Grad, age 34, formerly of Lexington Ridge in Medina, Ohio, to five years in prison for two counts of Endangering Children, both felonies of the fifth degree. Previously Judge Kimbler had found her guilty in a non-jury trial that took place in November. Judge Kimbler gave her credit for 55 days served in the Medina County Jail prior to her sentencing. Court costs were waived.

Judge Kimbler sentenced Brett W. Stillman, age 26, of Park Street in Wadsworth, Ohio, to 166 days in the Medina County Jail for Possession of Drugs, a fifth degree felony. He also received a six month suspension of his driver’s license. Court costs were waived. He was given credit for 166 days served in the Medina County Jail prior to his sentencing.

Judge Kimbler sentenced Dottie Colon, age 52, of Cleveland, Ohio, to a prison term of one year for Identity Theft; both third degree felony; six months in prison for each count on two counts of Forgery, a fourth degree felony; and six months in prison for one count of Theft, a fourth degree felony. All the prison sentences run concurrent with each other and concurrent with a prison term that was imposed by the Cuyahoga County Common Pleas Court.

Judge Kimbler sentenced Frederick C. Patterson, age 46, of Pine Crest Drive in Orange Village, Ohio, to one year in prison for Possession of Drugs, a third degree felony. Judge Kimbler also suspended his driver’s license for six months and ordered a mandatory fine of $5000.00. Judge Kimbler then suspended the fine and waived all court costs. Mr. Patterson received credit for 14 days served in the Medina County Jail prior to his sentencing.

Judge Kimbler sentenced Felecia L. Ward, age 22, of Crosby Street in Akron, Ohio, to community control sanctions for one count of Receiving Stolen Property, a fifth degree felony, and three counts of Receiving Stolen Property, all of which were first degree misdemeanors.

The community control sanctions included three years supervision by the Medina County Adult Probation Department, 24 hours of community service, drug assessment and any prescribed treatment by a state certified agency, restitution in an amount to be set by the Adult Probation Department, and a requirement that she either be employed full time or attend college full time. Judge Kimbler also ordered Ms. Ward to pay court costs and imposed a monthly community control sanction fee. If Ms. Ward violates the conditions of her supervision, she could receive a six month prison sentence.

Judge Kimbler sentenced David J. Jocke, age 41, of Sleepy Hollow Road in Brunswick, Ohio, to community control sanctions for Domestic Violence, a fourth degree felony.

The community control sanctions included three years of intensive supervised probation by the Medina County Adult Probation Department, 24 hours of community service, no consumption or possession of alcohol while under supervision, completion of the Violence Prevention Program offered by Alternative Paths and follow all aftercare recommendations of that program, drug/alcohol assessment and treatment as recommended by Alternative Paths, submit to random drug/alcohol testing and be arrested on first positive result; obtain and maintain verifiable and gainful employment; and pay all court costs, supervision fees and drug testing fees associated with this case. Mr. Jocke could be sentenced to six months in prison if he violates the conditions of his supervision.

Mark Dotson, 31, of East Walnut Street in Wadsworth, pleaded guilty and was sentenced to three years of community control sanctions on one count of Possession of Heroin, a fifth-degree felony.

Damian Johnson, 36, of Weymouth Road in Medina, pleaded no contest to the following charges: three counts of Trafficking in Cocaine; one count of Possession of Drugs; and one count of Possession of Cocaine; all of which are fifth-degree felonies. Sentencing is scheduled for February 4.

Jesse Lafferty, 27, of Liberty Street in Spencer, pleaded not guilty to the following charges: one count of Kidnapping, a first-degree felony; one count of Robbery, a second-degree felony; one count of Safecracking, a fourth-degree felony; and one count of Possession of Criminal Tools, a fifth-degree felony. A jury trial is scheduled for February 16.

Timothy Livingston, 22, of Hadcock Road in Brunswick, pleaded guilty to two counts of Attempted Trafficking in Marijuana, both of which are fifth-degree felonies. Sentencing is scheduled for February 4.

Val Scott McIntosh, 39, of High Street in Wadsworth, pleaded not guilty to one count of Forgery and one count of Theft, both of which are fifth-degree felonies. A jury trial is scheduled for March 3.

Susan Stalnaker, 46, of Ledge Road in Hinckley, pleaded not guilty to one count of Theft, a third-degree felony. A jury trial is scheduled for March 2.

Thomas Townsend, 53, of Ryan Road in Medina, pleaded no contest to one count of Possession of Drugs, a third-degree felony. Sentencing is scheduled for February 4
