Joseph L. Strehl, III, of Columbia Road in Valley City was found guilty Monday by Judge Kimbler of Operating a Motor Vehicle While Under the Influence of Alcohol, a first degree misdemeanor. The case was tried to Judge Kimbler since Mr. Strehl had waived his right to a jury trial.
Originally Mr. Strehl was charged with a felony. After the State rested its case on Friday, March 12, 2009, Mr. Strehl’s attorney moved for a directed verdict on acquittal on the specification that Mr. Strehl had previously been convicted of a felony DUI in Texas. Judge Kimbler granted that motion. The effect of granting the motion was to change the charge from a felony to a misdemeanor.
Following the announcement of his verdict, Judge Kimbler ordered a pre-sentence investigation and will impose sentence on April 29, 2010. Judge Kimbler also continued Mr. Strehl’s bond.
